Class Action Clinic
A request for approval of a class action was filed by the Clinic in collaboration with a private law firm, against Chevra Kadisha (Petah Tikva) on the grounds of its discriminatory burial policy of deceased Soviet Jews. In June 2021, the class action was approved by the court and set for pre-trial.
The Clinic, along with a private law firm, filed a request for approval of a class action against several Israeli hospitals on the grounds of wrongful discrimination of Arab women in maternity wards. The women were separated from their Jewish counterparts and put in separate rooms. The case is currently in pre-trial.
One of the Clinic’s activities is filing objections to settlements in class actions. This is of great importance to safeguarding the rights of members of the group who haven’t taken an active part in the proceedings. The Clinic has filed objections on behalf of the Israel Consumer Council, “KAV LAOVED” association and more. An example of an objection filed by the Clinic that resulted in substantial improvements for group members: the Clinic objected to a settlement in a lawsuit regarding the right of Holocaust survivors to be exempted from paying deductibles for treatments and medications. Thanks to the Clinic's intervention, more than ILS 17,000,000 have been returned to members of the group by Clalit Health Services.
